1. Counter Terrorism Division

Functions

  •     Handling prosecutions matters with respect to terrorism activities
  •     Study and evaluate case/ files presented for decisions whether to commence prosecution
  •     Advice the government on matters of prosecution of terrorism activities
  •     Liaise with the police in prosecution of terrorism suspects

 

2. Extradition, MLA and International Cooperation Division

The functions of this Division are:

Handle all matters relating to international cooperation, Extradition and Mutual Legal Assistance arising from the Office of the Director of Public Prosecutions
Offer Leadership, legal/policy guidance and supervision to the Office of the Director of Public Prosecutions and other agencies ensuring these officers adhere to approved legal frameworks, policies and guidelines relating to International cooperation, Extradition and mutual Legal Assistance.
In all cases:

  •      Study and evaluate case files presented and make appropriate decisions.
  •      Institute criminal charges in appropriate courts in respect of cases where decisions have been made to prosecute;
  •      Conduct criminal and related proceedings in relation to cases instituted before courts of law
  •     Draft and process documents relating to Extradition, MLA & International Cooperation as the case may be.
  •     Advise the Government, Ministries, Departments and other agencies on matters within their docket
  •     Handle international and regional treaties and other instruments having a bearing on Extradition, MLA and International Cooperation.
  •     Research, review and make recommendations on the status and quality of the relevant laws
  •     Prepare quarterly reports on matters relating to Extradition, MLA and International Cooperation.
  •     Propose and issue policies and strategies in matters relating to the docket
  •     Guide and advise the Office of the Director of Public Prosecutions and other investigating agencies on Extradition, MLA and International Cooperation.
  •     Analyze judgment, rulings, orders and where necessary prepare appropriate documents for appeal, review, or revision and related proceedings
  •     Advice MDAs on policy and strategic matters in relation to Extradition, MLA and international cooperation.

3. Piracy and Maritime Division

The functions of this Division are:

  •     Handle of prosecutions in respect of Piracy and Maritime crimes;
  •     Handle all matters relating to international cooperation on Piracy and Maritime legal matters, including mutual legal assistance, proceeds of crime, extradition and exchange of prisoners;
  •     In all cases:
    •         Study and evaluate case files presented for decision whether to or not to prosecute and make appropriate decisions.
    •         Draft documents relating to the prosecution and conduct of cases in respect of piracy and maritime crimes;
    •         Institute criminal charges in appropriate courts in respect of cases where decisions have been made t
    •         Conduct criminal and related proceedings in relation to cases instituted before courts of law.
  •     Advise the Office of the Director of Public Prosecutions, Government, Ministries, Departments and other agencies on legal, policy, procedures and strategies on matters related to piracy and maritime matters;
  •     Handle international and regional treaties and other instruments having a bearing on the prevention, control and prosecution of piracy and maritime crimes;
  •     Research, review and make recommendations on the status and quality of the relevant laws;
  •     Handle matters relating to tracing of criminals assets, seizure and  forfeiture proceedings as required by law;
  •     Prepare quarterly reports on matters relating to piracy and maritime offences and submit to head of department;
  •     Propose and develop policies and strategies in matters relating to the docket;
  •     Guide and advise investigating agencies on piracy and maritime offences;
  •     Analyze judgments, rulings, orders and where necessary prepare appropriate documents for appeal, review, or revision and related proceedings;
  •     Advice MDAs on policy and strategic matters in relation to piracy and maritime offences;
