The Department divided into Seven (7) core Divisions namely:

The core functions of the Department

The specific functions of the Department include:

  •     Handling prosecutions in respect of offences against persons such as murder, armed robbery, assault, rape, defilement, criminal defamation and public order offences such as treason and terrorism;
  •     Supervising the handling of prosecutions in respect of offences against persons and public order by County prosecution offices, including ensuring these offices adhere to approved policies and guidelines and submitting periodic returns;
  •     In complex cases:
    •      Studying and evaluating case files presented for decisions whether to or not to prosecute and making appropriate decisions.
    •      Drafting documents relating the prosecution and conduct of cases in respect of offences against persons and public authority.
    •      Instituting criminal charges in appropriate courts in respect of cases where decisions have been made to prosecute; and
  •     Conducting criminal and related proceedings in relation to cases instituted before courts of law.
  •     Advising the Government, Ministries, departments and other agencies on matters relating to offences against persons and public authority;
  •     Handling international and regional treaties and other instruments having a bearing on the prevention, control and prosecution of offences against persons and public authority;
  •     Researching, reviewing and making of recommendations on the status and quality of the laws on offences against persons and public authority.
  •     Preparing periodic reports on matters relating to offences against persons and public authority;
  •     Preparing guidelines on offences against persons and public authority;
  •     Guiding and advising investigating agencies in relation to offences against persons and public authority;
  •     Analyzing judgements, rulings, orders and where necessary preparing appropriate documents for appeal, review, or revision and related proceedings;
  •     Handling matters relating to local tracing of criminals assets and carrying out forfeiture proceedings as required by law;
  •     Handling matters relating to compensation and restitution in relation to offences against persons and public authority
  •     Proposing and issuing policies and strategies in matters relating to offences against persons and public authority; and,
  •     Advising MDAs on policy and strategic matters in relation to offences against persons or public authority
